in many weeks, and then I get this in my inbox tonite:

My name is Duke Moscrip. I am a Seattle businessman and owner of six restaurants called Duke’s Chowder House (www.dukeschowderhouse.com). I am an investor with Enrico Bartoli Orlandini. I believe that I have been defrauded by him. I was able to secure your email address in prior dealings with Bartoli. You are either an investor like me or a subscriber to his email reports. I started investing with him over two years ago and last year became distressed and suspicious regarding his handling of my accounts. My concerns began to escalate shortly after I made my very first request for a withdrawal of funds in early October 2008. The amount was $50,000, representing only 2 ½% of the market value of my investments according statements from Bartoli. I have received no money to date. As a former stock broker, I can assure you that getting any payment from an account is a matter of 5 days to settle the transaction. What I did receive is a continual lie about the wire that was supposedly sent. He sent me a phony confirmation number for a wire that proved to be a transfer from one of his accounts to another. Claiming that the banks were “having trouble,” he then sent a falsified wire transfer document from Scotia Bank in Panama with Joanna Gonzales listed as the banker at the bottom of the email. There is no Joanna Gonzales working for Scotia Bank. Subsequently I discovered that another investor, Wesley Burdette, requested a draw previously and still does not have money. Wesley sent me a copy of Enrico’s falsified wire transfer document with my personal banker’s name (she works at KeyBank in Seattle) listed as the banker for Scotia Bank in Panama. On December 17, 2008, I requested a total liquidation of my accounts. He said that he “would take care of it.” No money has arrived. I know of nine other investors whose requests for withdrawals are being ignored. As my suspicions have been aroused during this period, a friend and fellow investor and I started doing some digging.

Here’s what we found.

Enrico B. Orlandini, aka Eric V Bartoli, now operating under the name Dow Theory Analysis, is a fugitive from the U S Justice system, wanted on ten counts of defrauding investors in Ohio and was barred from dealing with securities by the Securities and Exchange Commission (SEC) back in 2001. There is a $49 million judgment against him. As you know, he operates out of Lima, Peru. Google Eric Bartoli and you will see the truth.

If you have invested money with him, have you been able to get any money returned? Do you know of other investors or subscribers to the DT Analysis reports who might be interested in these developments? I would appreciate if you would so advise.

I believe that Bartoli has defrauded me. If you have an interest in joining me in legal action against him, please respond to my email address duke@dukeschowderhouse.com. If you have started legal action yourself, please let me know so we can coordinate our efforts. I, along with my friend and fellow investor Ramer Holtan, have funded the first efforts by hiring and paying for initial legal fees with a law firm in Lima by the name of Rodrigo, Elias & Medrano.

Yours truly,
